China to publish framework of IPR strategy in August

Chinanews, May 22 �C The framework of the nation's intellectual property
strategy right (IPR) will surface in August, The Economic Observer
Newspaper reported, citing Wen Xikai, Secretary-general of the Office of
Leading Group on Making Intellectual Property Rights Strategy
(Intellectual Property Rights Office).
The questions concerning whether the administrative departments related
with IPR would be amalgamated and how was the amalgamation to be effected
were expected to be unveiled at that time.
The nation's IPR strategy involves an argumentation about the combination
of the three administrative departments including patent, trade mark and
copyright, which were faced with the relocation of rights. Li Mingde,
researcher of the Intellectual Property Rights Research Centre of the
Chinese Academy of Social Sciences (CASS) said CASS was at present
leading the study of the project on the argumentation with full effort.
The strategy includes one outline and twenty special topics, with the
legal topic studied by CASS. The law enforcement included in the topic
will involve the establishment of law enforcement departments, or the
questions of who is the subject of the law enforcement, and whether the
related departments would be amalgamated.
Zhao Gang, Deputy Chief of the Trademark Bureau in the State
Administration of Industry and Commerce, said the present department
arrangement was the result of several historical reasons.
"In the early days of the People's Republic, there was a department in
charge of trade mark , which had originally involved patent,�� Zhao said.
The State Administration of Industry and Commerce was directly under the
State Council, and also was the Copyright Bureau under the General
Administration of Press and Publications. Therefore, all the decisions
related with the reform of any department would be made by the State
Council.
